The following Terms and Conditions are applicable on those individuals who register on our Website, www.karosambhav.com or call us at 1800-2121-434 (“Registrant”) for the purpose of picking up of e-waste (“Service”). Individuals who register for the Service are referred to as “Registrant” in this document. It is notified to individual that the Service is available on specific dates and in specific locations only.
The Registrant agrees to abide by the following terms and conditions while availing the Service:
- The Registrant, hereby agree and confirm that the Registrant is handing over the e-waste to Karo Sambhav for recycling purposes. The Registrant further understands that Karo Sambhav will not be liable to return the e-waste once the e-waste has been accepted by them. The e-waste once given to Karo Sambhav shall become the property of Karo Sambhav and Registrant shall have no right to claim ownership on the given e-waste.
- Karo Sambhav or its partners will not be liable or responsible for any items handed over by the registrant. If the items handed by the registrant are found to be illegal under the laws of the Republic of India, legal proceedings shall be initiated against the Registrant by Karo Sambhav and the Registrant shall indemnify Karo Sambhav against all liability, losses, costs, charges, penalties, damages, fines and expenses (including but not limited to, legal costs and expenses) incurred by Karo Sambhav.
- The Service provided by Karo Sambhav may be recorded via audio/pictures/videos that may be uploaded on social media or web pages of Karo Sambhav.
- Karo Sambhav shall remain the sole owner of the media content developed by Karo Sambhav relating to Service. All intellectual property rights associated with the developed media content shall exclusively and perpetually remain with Karo Sambhav.
- Karo Sambhav’s representative/pickup partner may conduct a check on the consignment. The registrant must refrain from handing over tube lights, CFLs or/and any item that is not listed in all or either of the below options:
- the list shared with the Registrant in prior communication with Karo Sambhav
- displayed on poster, signage, website, social media or any other media and campaign material
- shared with the Registrant during or before the pickup/drop-off
- Any request for Service shall be termed as active for a period of 7-21 days, which will be counted from the day of request made. The Service shall be provided during this tenure of 21 days.
- Pickups might be re-scheduled due to unforeseen circumstances or due to change in operating hours due to weekends/public holidays/in natural calamity struck areas/at the time of a natural disaster/politically affected days or areas. Karo Sambhav retains the sole discretion to re-schedule the pick-up. Karo Sambhav will intimate the Registrant of any change in the pick-up schedule in a reasonable period of time.
- Pickups can take place at any time during the requested slot. The Registrant is requested to be available for the same.
- One must be 18 years of age or older to hand over the e-waste, in case minor, a consent from the guardian is mandatory.
- Karo Sambhav holds the right to:
- Reject a part or whole consignment if items are found to be from “Do not hand over List” as available in Annexure 1.
- Commercialise the e-waste even if the Registrant has handed over “in kind”.
- The handover of e-waste can be in exchange of kind, cash, or money transfer through electronic media. Karo Sambhav shall have the exclusive right to decide the price for the e-waste and organize a pickup only if the weight is more than 2kg.
- This scheme is purely a promotional scheme with the aim to spreading awareness on e-waste and no participant will have any right or claim against Karo Sambhav.
- Registrant shall indemnify, defend and hold harmless the Karo Sambhav, its respective directors, employees and agents (“Indemnified Parties”) against all liability, losses, costs, charges, penalties, damages, fines and expenses (including but not limited to, legal costs and expenses) incurred by the Indemnified Parties in connection with any demand, claim (including third party claims) or proceedings or actions of any nature whatsoever made or instituted against or caused to or suffered by the Indemnified Parties by reason of or as a result of and defend and save each of them harmless, from and against any and all losses, damages, liabilities, costs and expenses (including reasonable attorneys' fees and expenses) in connection with any and all suits, investigations, claims or demands arising from or occurring as a result of: (a) any breach or failure by the Registrant to perform its obligations under the terms and conditions of the scheme; (b) breach of any representations and warranties under the terms and conditions of the scheme; (c) gross negligence or willful misconduct of the Registrant in performing its respective obligations under this Agreement; (d) any violation of applicable laws.
- Karo Sambhav reserves absolute right to cancel or discontinue or terminate the scheme at any time. Karo Sambhav reserves the right to amend, withdraw or revise these rules at any time without notice and in such event Karo Sambhav shall not have any liability whatsoever.
- Registrant shall be responsible for providing correct information to Karo Sambhav with respect to e-waste and shall indemnify Karo Sambhav in case any event occurs due to information provided by the Registrant and acted upon by Karo Sambhav.
- Karo Sambhav shall not be responsible for the acts committed by Registrant on the basis of information provided by Karo Sambhav.
- Karo Sambhav and the Registrant shall be under obligations to follow all the applicable laws, including but not limited to E-waste (Management) Rules, 2016.
- Any dispute arising out of the above terms & conditions will be referred to a sole Arbitrator mutually appointed by the parties to the dispute, whose decision shall be final and binding on the parties. The place of Arbitration shall be New Delhi. The Arbitration shall be conducted in accordance with Arbitration and Conciliation Act, 1996. The courts of Delhi shall have exclusive jurisdiction over any dispute arising by virtue of the terms and conditions.
